Attendu qu'il est constant que [la société Carbone Casual] est titulaire sur le territoire du Benelux de la marque commerciale CARBONE déposée le 16 juin 1995 ;
Que d'autre part, il ressort des productions que le site internet de la société Carbone Casual ne fait pas usage de la langue française, les langues disponibles étant le flamand, l'anglais et l'allemand et qu'aucune commercialisation des produits présentés n'est possible sur le territoire français ;

ccTLD news

From tomorrow, numeric .nl names can be registered, and new dispute resolution rules are applicable to all .nl domain names.

A new dispute resolution policy is also put in place in the .pe namespace. It is based on the UDRP, and administered by WIPO. Contrary to the UDRP, this procedure applies to domain names that are identical or confusingly similar to a trademark or service mark in which the Complainant has rights previously registered or "filed" in Peru, and it will be sufficient to prove that either registration or use of the domain name by the registrant occurred in bad faith.
