New publication

Jacqueline Lipton, Who Owns 'Hillary.Com'? Political Speech and the First Amendment in Cyberspace, [2008] Boston College Law Review (Spring).
This article examines the large gaps and inconsistencies in American domain name law and UDRP as to domain name use in the political context (like "kerryedwards.com"). Current domain name policy is focused on protecting trademark uses of domain names against cybersquatters, and does not deal with protecting uses of domain names as part of the political process.
The article also discusses the Californian Act against cyberfraud.
