When it first tried to claim googles.eu, Google Inc. failed, because it was not eligible: .eu registrations are open only to undertakings having their registered office, central administration or principal place of business within the Community, or organizations established within the Community without prejudice to the application of national law, or natural persons resident within the Community.
The second attempt is successful: Google Ireland was the complainant. The respondent's contentions (in Spanish), although as long as original, did not convince the panel.
The panel finds that the "non bis in idem" rule does not apply. Then follows the routine "similar name + similar use = transfer".
