A French firm has been sentenced for spamming from a @hotmail address (so for an address linked to this domain name).
In the equivalent of a preliminary injunction, the Paris court found that the spammer was infringing Microsoft trademark. There is no reference to the terms of use, which require the user not to use the account for commercial purposes.

Actually, the defendant din't have an account at Hotmail, and only used the trademark in the "heading".
