US: 9th Circuit court overturns injunction in "nissan.com" case

In Nissan Motor Co. v. Nissan Computer Co., the 9th Circuit Court of Appeals has upheld the rights of members of the public to criticize corporations without being deemed to have engaged in "commercial speech" that can be enjoined under the trademark laws. A trial court had issued an order forbidding Uzi Nissan, the domain name owner of nissan.com from using his website to criticize Nissan Motor in any way, even by linking to disparaging Web sites.
